EB-2 Eligibility: Two Pathways to Qualify
The EB-2 is the employment-based second preference immigrant visa for foreign nationals with an advanced degree or exceptional ability in the sciences, arts, or business. USCIS recognizes two qualification routes.
Advanced Degree Route
You qualify if you hold a U.S. master’s degree or foreign equivalent, or a U.S. bachelor’s degree combined with at least five years of progressive post-degree experience in your specialty. That experience must follow the degree and relate directly to your field or proposed endeavor.
Exceptional Ability Route
Applicants without an advanced degree may qualify by demonstrating expertise significantly above what is ordinarily encountered in their field. USCIS requires you to satisfy at least three of six regulatory criteria: an official academic record in the field, ten or more years of full-time experience documented by employer letters, a professional license or certification, a history of commanding a salary reflecting exceptional ability, membership in professional associations, and recognition by peers, government entities, or professional organizations.
Most standard EB-2 petitions require a U.S. employer to file Form I-140 and obtain a PERM labor certification from the Department of Labor, confirming no qualified U.S. worker is available. Professionals in certain Schedule A occupations, such as some physical therapists and registered nurses, may be exempt from the labor certification requirement.
The National Interest Waiver: Self-Petitioning Without an Employer Sponsor
The National Interest Waiver (NIW) lets EB-2-qualified applicants file Form I-140 directly with USCIS without an employer sponsor or PERM labor certification, when USCIS determines the waiver serves U.S. national interests. To qualify, you must first establish EB-2 eligibility, then satisfy the three-prong Dhanasar test: your proposed endeavor has substantial merit and national importance; you are well-positioned to advance it; and waiving the job offer requirement would benefit the United States.
Fields commonly recognized under NIW include engineering, medicine and public health, technology and cybersecurity, scientific research, and entrepreneurship that creates jobs or drives economic development. The list isn’t exhaustive.
A January 2025 USCIS policy update increased scrutiny on NIW eligibility, with closer review of whether an applicant’s occupation qualifies as a profession and whether any claimed exceptional ability relates directly to the proposed endeavor. A well-constructed petition matters more than ever: it needs documented evidence that your work has impact beyond a single employer, strong support letters, and a clear narrative of the endeavor’s national benefit.
