The full EB-3 process commonly takes several years or more, depending on subcategory, country of chargeability, USCIS backlogs, and whether the case is audited. These timelines are approximate and subject to change.
Derivative Status for Spouses & Children
An approved EB-3 petition may allow a worker’s spouse and unmarried children under 21 to apply for derivative visa status alongside the principal applicant. Spouses of skilled workers or professionals may apply under E34; spouses of other workers under EW-4. Unmarried children follow under E35 or EW-5 depending on the worker’s subcategory. Spouses may also be eligible to apply for an Employment Authorization Document while awaiting permanent residency. All derivative benefits are conditional on approval and subject to the same priority date and visa availability constraints as the principal applicant’s case.
