Stage Two: Consular Processing and Entry
The foreign fiancé completes Form DS-160, pays applicable fees, undergoes a required medical examination, obtains a police clearance certificate, and attends a consular interview. The consular officer assesses whether the relationship is genuine. If approved, the fiancé must enter the United States and the couple must marry within 90 days. That window can’t be extended under any circumstances.
After marriage, the foreign spouse files for adjustment of status using Form I-485 to obtain lawful permanent residency. Form I-765 for employment authorization may be filed at the same time. When filed alongside Form I-485, work authorization is valid for one year and may be extended while the adjustment application is pending. One important limitation: a K-1 holder may only adjust status based on marriage to the original petitioning U.S. citizen.
