Family Visa Pathways: Understanding Which Category Applies to You

Before filing a single form, you need to know which category your family relationship falls into. The path forward depends on whether the petitioner is a U.S. citizen or a lawful permanent resident, the nature of the relationship, and whether the beneficiary is currently inside or outside the United States.

QUICK REFERENCE
Family Visa Pathways
Which category applies depends on your relationship and the petitioner’s status.
Immediate Relative Visas
Available to spouses, unmarried children under 21, and parents of U.S. citizens who are 21 or older. No annual cap on green cards in this category, generally making it the fastest route to lawful permanent residence.
Family Preference Categories
Cover relationships outside immediate relatives: unmarried adult children of U.S. citizens (F1), spouses and unmarried children of permanent residents (F2), married children of U.S. citizens (F3), and siblings of U.S. citizens 21 or older (F4). Subject to annual quotas; wait times can be significant depending on country of birth.
K-1 Fiancé & Marriage Visas
K-1 fiancé visas allow a foreign national engaged to a U.S. citizen to enter the country for 90 days to marry, after which they may apply for adjustment of status. Spouses already married abroad may pursue a marriage-based immigrant visa through consular processing.

Vindigni & Zeka Law Group assists clients with family-based visa applications and green card petitions, including both family-sponsored and marriage-based pathways. We handle immigration cases for clients nationally, not only in the Ewing Township area.

What Happens After a Petition Is Filed

Filing the I-130 petition is the starting point, not the finish line. What comes next depends on where the beneficiary is located and whether a visa number is immediately available.

If the beneficiary is already in the United States, adjustment of status allows them to apply for a green card without leaving the country. If the beneficiary is abroad, the case moves through the National Visa Center and concludes with a consular interview at a U.S. embassy or consulate. For immediate relatives of U.S. citizens, a visa number is available as soon as the petition is approved. Preference category beneficiaries must wait for a visa number to become current on the State Department Visa Bulletin, which can take years for certain countries and categories.

Incomplete documentation and filing errors are among the most common reasons USCIS issues a Request for Evidence, which can add months to processing times. We ensure applications are properly prepared and all documentation is complete and accurate before anything is submitted.

A prior denial doesn’t necessarily close the door. Vindigni & Zeka Law Group handles immigration appeals and motions to reopen or reconsider when a case has been denied, including representation before the Board of Immigration Appeals. If a petition was previously filed incorrectly or rejected, we can review what happened and identify the available options.

Why Ewing Township Families Work with Vindigni & Zeka

Immigration clients face a specific kind of uncertainty: timelines are long, communication from agencies is inconsistent, and a single missed deadline can set a case back significantly. We treat that reality as a reason to communicate more, not less.

Our Google-verified reviews, confirmed through Trustindex as originating from Google, describe our communication as “unmatched.” Clients note that calls are returned promptly and updates arrive the moment anything changes in their case. That standard applies equally to immigration clients navigating a family visa petition.
