The Marriage Visa Process: From I-130 to Green Card
The process begins with filing Form I-130, Petition for Alien Relative, with USCIS. Once approved, the case transfers to the National Visa Center (NVC), which collects fees and required documents including the I-864 Affidavit of Support, Form DS-260, civil documents (birth certificate, marriage certificate, police certificates), and passport photos. The sponsoring U.S. citizen or lawful permanent resident must demonstrate sufficient income to support the intending immigrant; a joint sponsor can be added when income requirements aren’t met on their own.
After NVC processing, the foreign spouse attends a medical examination with an approved physician and a visa interview at the U.S. consulate in their home country. One detail many couples miss: if the foreign spouse has been married for fewer than two years when the green card is issued, USCIS grants a conditional permanent residence card that expires in two years. The couple must then file Form I-751, Petition to Remove Conditions on Residence, within the 90-day window before that card expires. Missing that window can trigger removal proceedings.
