The EB-1 category covers three distinct groups of priority workers. Which path applies to you depends on your professional profile, your relationship with a U.S. employer, and the evidence you can document.

PRIORITY WORKER CATEGORIES
The Three EB-1 Subcategories
All three skip the PERM labor certification requirement, giving EB-1 applicants shorter wait times than EB-2 or EB-3 pathways.
EB-1A: Extraordinary Ability
For individuals with sustained national or international acclaim in sciences, arts, education, business, or athletics. No job offer required — self-petition by filing Form I-140 directly with USCIS.
EB-1B: Outstanding Professors & Researchers
For academics and researchers with at least 3 years of teaching or research experience and international recognition. A U.S. employer must file the I-140 and offer a qualifying permanent position. Self-petition is not available.
EB-1C: Multinational Managers & Executives
For senior professionals transferring within a multinational organization. Applicant must have worked abroad in a managerial or executive capacity for at least one continuous year in the three years preceding the petition.

EB-1A: Extraordinary Ability

This subcategory is for individuals with sustained national or international acclaim in the sciences, arts, education, business, or athletics. No job offer is required. An EB-1A applicant can self-petition by filing Form I-140 directly with USCIS without an employer sponsor, as long as they intend to continue working in their field in the United States.

To qualify, an applicant must either document receipt of a single major internationally recognized award (such as a Nobel Prize, Pulitzer, or Olympic Medal) or satisfy at least three of ten USCIS evidentiary criteria. Those criteria include published material about the applicant’s work, original contributions of major significance, membership in distinguished associations, judging the work of peers, and similar evidence of sustained recognition.

EB-1B: Outstanding Professors & Researchers

EB-1B is for academics and researchers with at least three years of teaching or research experience and international recognition in their field. A U.S. employer must file the I-140 petition and offer a qualifying tenure-track or permanent research position. Self-petition isn’t available under this subcategory.

EB-1C: Multinational Managers & Executives

This subcategory applies to senior professionals transferring within a multinational organization. To qualify, the applicant must have worked abroad in a managerial or executive capacity for at least one continuous year during the three years preceding the petition. The U.S. company must file the I-140 and have a qualifying corporate relationship (parent, affiliate, or subsidiary) with the foreign organization.

All three subcategories skip the PERM labor certification requirement, which is one reason EB-1 applicants often face shorter wait times than those pursuing EB-2 or EB-3 pathways.

The EB-1 Petition Process

Every EB-1 case begins with filing Form I-140, Immigrant Petition for Alien Worker, with USCIS. Under EB-1A, the beneficiary files directly. Under EB-1B and EB-1C, the U.S. employer files on the applicant’s behalf. Premium processing is available and requires USCIS to respond within 15 business days for EB-1A and EB-1B petitions, or 45 business days for EB-1C. Premium processing covers only the I-140 stage and won’t accelerate adjustment of status or consular processing.

Once the I-140 is approved, applicants already in the U.S. in valid nonimmigrant status may file Form I-485 for adjustment of status. Applicants abroad pursue consular processing at a U.S. embassy or consulate. USCIS may issue a Request for Evidence (RFE) during adjudication, meaning additional documentation is needed before a decision can be made. An RFE isn’t a denial, but responding thoroughly and on deadline is critical.
